This policy distinguishes between the legal right of withdrawal, returns due to lack of conformity or defects, and any additional commercial exchanges that BambaKicks may offer.
1. Right of withdrawal: 14 calendar days
Where the purchase is made at a distance and the buyer is a consumer, they generally have 14 calendar days to withdraw from the purchase without giving a reason. The period normally starts on the day the consumer, or a third party designated by them, physically receives the goods.
To exercise the right, it is sufficient to communicate an unequivocal decision before the deadline by writing to bambakicks@gmail.com and stating the order number and affected items.
2. Returning the products
After communicating withdrawal, the goods must be returned without undue delay and no later than 14 calendar days afterwards. The consumer is only responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.
For safety, we recommend returning items properly protected, with accessories and packaging where reasonably possible. The absence of original packaging does not by itself remove a legal right of withdrawal, although deterioration caused by excessive handling may lead to a reduction in the refund.
3. Return cost
Unless BambaKicks expressly states that it will bear the cost, the consumer must bear the direct cost of return where they were informed of this before purchase. If the return is due to a defective, incorrect or non-conforming product, the applicable legal rights will apply and the necessary costs of bringing the product into conformity will not be borne by the consumer.
4. Refund
In the event of a valid withdrawal, the payments legally due will be refunded, including ordinary initial delivery costs where applicable. The refund will be made without undue delay and generally using the same payment method used for the purchase, unless otherwise validly agreed. BambaKicks may withhold the refund until the goods are received or until the consumer provides sufficient evidence of return, where permitted by law.
5. Legal exceptions to withdrawal
The right of withdrawal may not apply in legally provided cases, including goods made to the consumer's specifications or clearly personalised, or certain sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed after delivery.
6. Incorrect, defective or non-conforming product
If you receive an item different from the one purchased, damaged or potentially non-conforming, write to bambakicks@gmail.com with the order number and, when useful, photos of the product. This process is separate from withdrawal and is governed by the legal conformity guarantee.
7. Size exchanges
Size exchanges voluntarily offered by BambaKicks are subject to availability. Where the customer exercises a legal right of withdrawal, they may return the product under this policy and, if desired, place a new order for the correct size.
8. Model withdrawal form
The consumer may use the following text, although it is not mandatory:
“To BambaKicks: I hereby give notice that I withdraw from the sales contract relating to order no. ______, received on ___/___/____. Consumer name: ______. Address: ______. Date: ______. Signature (only if submitted on paper): ______.”
