This page summarises the main rights relating to defective or non-conforming products and the complaint procedure at BambaKicks.
1. Legal guarantee of conformity
For new goods sold to consumers in Spain, BambaKicks is responsible for lack of conformity that becomes apparent within the legal period of three years from delivery. This right is independent of any additional commercial warranty offered by a brand or manufacturer.
2. What is a lack of conformity?
A lack of conformity may exist, among other cases, where the product does not reasonably correspond to the promised description, type, quantity, quality or characteristics, is not suitable for ordinary use, or has a defect not caused by normal use, wear, accident or improper handling.
3. Remedies
Where a lack of conformity exists, the consumer may, depending on the legal circumstances, be entitled to have the goods brought into conformity by repair or replacement and, where appropriate, to a price reduction or termination of the contract. Measures to bring the goods into conformity must be free of charge for the consumer under the terms established by law.
4. Presumption during the first years
Unless proven otherwise and subject to legally applicable exceptions, lack of conformity appearing during the first two years from delivery of goods is presumed to have existed at the time of delivery.
5. How to make a complaint
Email bambakicks@gmail.com with your order number, a description of the issue and, where useful for assessment, photos or video. Unnecessary evidence is not required, but this information can help speed up the process.
6. Third-party products
Where BambaKicks sells products from other brands, the consumer relationship remains with the seller under the legally established terms. Any commercial warranty provided by the manufacturer is additional to the consumer’s legal rights and does not replace them.
7. Consumer complaints
If an issue cannot be resolved directly, the consumer may contact the relevant public consumer bodies or competent alternative dispute resolution bodies. The former European Online Dispute Resolution (ODR) platform ceased operating in 2025, so no obsolete link to that platform is included.
